1. Who we are

Glow Marketing is a brand operated by Luxor Partners LLC. Luxor Partners LLC is the legal entity behind this website and is the data controller responsible for the personal data described in this policy.

Glow Marketing is a marketing agency that helps weight-loss clinics in the United States acquire patients. The people who submit forms on this website are clinic owners and clinic decision makers requesting a free 30-minute acquisition audit call. This policy explains what we do with the information they give us, and with the information our website collects automatically.

This policy applies to apply.getglowmarketing.com, including the marketing opt-in pages and the SMS opt-in page at apply.getglowmarketing.com/sms-optin.

2. What data we collect

Information you give us

Information we collect automatically

We do not intentionally collect special category data (such as health data about you personally), and we ask that you do not send it to us. Our service is business to business: the information we want is about your clinic, not about any patient.

3. How and why we use your data

We use personal data for the purposes below. Where the GDPR or UK GDPR applies, the legal basis for each purpose is shown.

We do not use your personal data to make decisions about you by automated means that produce legal effects or similarly significant effects.

4. SMS text messaging

We send SMS text messages only to people who explicitly opt in on our SMS opt-in page at apply.getglowmarketing.com/sms-optin. The consent box is optional and is unchecked by default. You do not need to tick it in order to submit the form, to book an audit call, or to work with us.

Our commitment on mobile data

No mobile information or SMS opt-in data is shared with third parties or affiliates for any purpose. Mobile opt-in data and consent are never sold, rented, or shared with third parties for their marketing or promotional purposes.

The only parties that ever handle your mobile number for SMS are the service providers we use to actually deliver the messages and to store your record, acting on our instructions and for no purpose of their own. They are listed in section 6. A phone number you give us on the SMS opt-in page is not transmitted to any advertising platform.

What we text you about

If you opt in, we send you two types of message and no others:

  1. Booking confirmations and reminders for the audit call you scheduled with us.
  2. Conversational follow-ups from a representative of Glow Marketing about the enquiry you submitted.

We do not send marketing or promotional text messages, and we do not send text messages to anyone who has not opted in.

Frequency, cost, and opting out

You can withdraw your SMS consent at any time by replying STOP to any message, or by emailing hello@glowmarketing.se and asking us to remove you. Withdrawing consent stops future text messages. It does not affect the lawfulness of messages we sent before you withdrew it, and it does not stop us contacting you by email or phone about your enquiry unless you also ask us to stop that.

5. Advertising, analytics and cookies

We advertise our own services, and we measure how that advertising performs. This section explains exactly what that involves, and where it does and does not apply. Please read it alongside the commitment in section 4.

The distinction, stated plainly

Technologies we use on the funnel pages

These providers act as independent controllers or joint controllers for some of this processing, and they may use the data they receive in accordance with their own privacy policies. We use this data to measure and optimise Glow Marketing's own advertising. We do not sell your data, and we do not provide your contact details to any third party so that the third party can market its own products to you.

Cookies

Cookies and similar identifiers are small files stored in your browser. We use them to remember which version of a page you were shown (so that an A/B test stays consistent for you), to measure traffic, and for the advertising measurement described above. You can block or delete cookies through your browser settings, and you can use your device or browser controls to limit advertising tracking. Blocking cookies may stop parts of the site from working correctly. You can also opt out of interest-based advertising through the controls Meta provides in your Meta account settings.

6. Who we share data with

We share personal data with the service providers below, who process it on our behalf and on our instructions. We do not authorise them to use it for their own purposes.

Who we do not share data with

We may disclose personal data if we are legally required to do so, for example in response to a valid legal request from a public authority or a court, or where disclosure is necessary to establish, exercise, or defend legal claims. If our business is sold or reorganised, personal data may be transferred to the acquiring entity, which would remain bound by this policy.

7. International transfers

Luxor Partners LLC is registered in the United States, and our team operates from Sweden. If you are in the European Economic Area, the United Kingdom, or Switzerland, your personal data will be transferred to and processed in the United States, and may be processed by our service providers in other countries.

Where we transfer personal data out of the EEA or the United Kingdom to a country that has not been recognised as providing an adequate level of protection, we rely on the European Commission's Standard Contractual Clauses (and, for the United Kingdom, the UK International Data Transfer Addendum) as the transfer mechanism, together with any additional safeguards required. You can ask us for information about the safeguards that apply to a particular transfer by emailing hello@glowmarketing.se.

8. Data retention

We keep personal data only for as long as we need it for the purposes set out in this policy.

You can ask us to delete your data sooner. See section 10 and section 11.

9. Security

We take reasonable technical and organisational measures to protect personal data against loss, misuse, and unauthorised access. These include encryption of data in transit over HTTPS, access controls and authentication on the systems that hold personal data, limiting access to the people who need it, and using established service providers who maintain their own security programmes. Identifiers sent to Meta for advertising measurement from the funnel pages are hashed before transmission.

No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If you believe your data has been compromised, contact us at hello@glowmarketing.se.

10. Your rights (GDPR and UK GDPR)

If you are in the European Economic Area or the United Kingdom, you have the following rights in relation to your personal data:

To exercise any of these rights, email hello@glowmarketing.se. We will respond within one month. We may need to verify your identity before we act on a request. Exercising your rights is free of charge, and we will not treat you differently for doing so.

11. Your rights (California, CCPA and CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the following rights:

We do not sell personal information

We do not sell personal information, and we have not sold personal information in the preceding 12 months. We do not sell or share the personal information of anyone we know to be under 16.

Under the CCPA as amended, disclosing personal information to an advertising platform for cross-context behavioural advertising can count as sharing, even where no money changes hands. The advertising measurement we carry out with Meta on the funnel pages, described in section 5, may fall within that definition. It does not apply to the SMS opt-in page: no mobile information or SMS opt-in data is shared with third parties or affiliates for any purpose.

Do Not Sell or Share My Personal Information

To opt out of any such sharing, email hello@glowmarketing.se with the subject line "Do Not Sell or Share My Personal Information", and include the email address or phone number you used on our site so that we can find your record. You can also opt out by rejecting or deleting cookies in your browser, and by enabling a Global Privacy Control signal, which we honour as a valid opt-out request from the browser that sends it. We will action your request and will not discriminate against you for making it. An authorised agent may submit a request on your behalf if they provide proof that you authorised them to do so.

12. Children

Our service is intended for businesses, and this website is directed at clinic owners and other business decision makers. It is not directed at children, and we do not knowingly collect personal data from anyone under 18. If you believe a child has given us personal data, contact hello@glowmarketing.se and we will delete it.

13. Changes to this policy

We may update this policy from time to time, for example if we change the tools we use or the way we handle data. When we do, we will change the "Last updated" date at the top of this page and publish the new version here. If a change materially affects how we use your personal data, we will take reasonable steps to tell you directly. Please check this page from time to time.
